1. The Agreement

The agreement consists of these terms of sale, the information provided in the order process, and any separately agreed terms. In the event of a conflict between the information, any specially agreed terms between the parties shall take precedence, provided that this does not conflict with mandatory legislation. The agreement is also supplemented by relevant Norwegian laws governing the sales of goods between businessen and consumers.

 

2. The Parties

The seller is Emilie Reichel-Marthinussen, Lyngåsen 8, email: emirei@hotmail.no, phone: +47 97488516, organization number: 932701636, hereafter referred to as the Seller.The buyer is the consumer who places the order, hereafter referred to as the Buyer.

3. Price

The stated price for goods and services is the total price the Buyer shall pay. This price includes all taxes and additional costs. The Buyer shall not bear any additional costs that the Seller did not inform about before the purchase was made.

4. Conclusion of the Agreement

The agreement becomes binding once the Buyer has submitted an order to the Seller. However, the agreement is not binding if there has been a writing or typing error in the Seller’s offer on the website or in the Buyer’s order, and the other party realized or should have realized that such an error existed.

 

5. Payment

The Seller may request payment for the goods once they have been shipped to the Buyer. If the Buyer uses a credit or debit card, the Seller may reserve the purchase amount on the card at the time of order. The card will be charged the same day the goods are shipped. If payment is made by invoice, the invoice will be issued when the item is shipped. The payment deadline appears on the invoice and is a minimum of 14 days from receipt. Buyers under 18 years of age cannot pay by invoice. We use Dintero Checkout as our payment solution.

 

6. Delivery

Delivery has taken place when the Buyer, or the Buyer’s representative, has received the goods. If no delivery time is stated in the order process, the Seller must deliver the goods without undue delay and no later than 30 days after the order is placed. Goods are delivered to the Buyer’s address unless otherwise agreed. Orders are shipped the same day or within 3 business days after the order is placed. Delivery time is normally 2–5 business days within Norway.


7. Transfer of Risk

The risk for the goods passes to the Buyer when they, or their representative, have received the goods in accordance with Section 6.

 

8. Right of Withdrawal

Unless the agreement is exempt from the right of withdrawal, the Buyer may cancel the purchase in accordance with the Norwegian Right of Withdrawal Act.

The Buyer must notify the Seller within 14 days from the date the withdrawal period begins. If the deadline falls on a Saturday, Sunday, or public holiday, it is extended to the next business day.

The withdrawal period is considered met if the Buyer sends notification before the deadline expires. The Buyer has the burden of proof for having exercised the right of withdrawal, so the notice should be made in writing (for example, email).

The withdrawal period begins:

  • For a single item: the day after the goods are received.
  • For subscriptions or regular deliveries: the day after the first delivery is received.
  • For orders with multiple deliveries: the day after the last delivery is received.

If the Seller fails to provide the required withdrawal information, the period is extended by 12 months. Once the information is provided, the period expires 14 days later.

When using the right of withdrawal, the item must be returned to the Seller without undue delay and no later than 14 days after notification. The Buyer bears the direct cost of returning the item unless otherwise agreed. The Seller may not charge fees for exercising the right of withdrawal.

The Buyer may examine the product in a reasonable manner to determine its nature and function without losing the right of withdrawal. If the product has been used beyond what is necessary, the Buyer may be held liable for any diminished value.

The Seller must refund the purchase amount without undue delay and no later than 14 days after receiving notice of withdrawal. The Seller may withhold payment until the goods have been received or documentation is provided that the goods have been returned.

9. Delays and Non-Delivery

If the Seller does not deliver the goods in accordance with the agreement, and the delay is not due to the Buyer, the Buyer may, in accordance with Norwegian consumer law, withhold payment, demand performance, cancel the purchase, and/or claim compensation.

To demand a remedy, the Buyer should notify the Seller in writing (e.g., email). If the Seller does not deliver within an agreed or reasonable additional deadline, the Buyer may cancel the purchase. The Buyer may also cancel immediately if delivery at the agreed time was essential.

 

10. Defective Goods

If a defect is discovered, the Buyer must notify the Seller within a reasonable time after it was or should have been discovered. The Buyer is always considered to have given timely notice if it is within two months of discovery. The complaint period is two years from delivery, or five years if the item is intended to last significantly longer.

If a defect exists, the Buyer may withhold payment, demand repair or replacement, claim a price reduction, cancel the purchase, and/or claim compensation in accordance with consumer law.

 

11. Seller’s Rights in Case of Buyer’s Default

If the Buyer does not pay or fulfill their obligations, and the reason is not due to the Seller, the Seller may withhold the goods, demand payment, cancel the agreement, and/or claim compensation. The Seller may also claim interest on late payment, collection fees, and a reasonable fee for uncollected goods.

 

12. Guarantee

Any guarantee provided by the Seller or manufacturer gives the Buyer rights in addition to those under mandatory consumer protection law.

13. Personal Data

The Seller is responsible for the processing of personal data. Unless the Buyer consents otherwise, the Seller may only collect and store the information necessary to fulfill the agreement. Personal data will only be shared with others when required to complete the transaction or by law.

14. Dispute Resolution

Complaints should be directed to the Seller within a reasonable time. The parties will attempt to resolve disputes amicably. If no agreement is reached, the Buyer may contact the Norwegian Consumer Authority (Forbrukertilsynet) for mediation at +47 23 400 600 or www.forbrukertilsynet.no. Consumers within the EU can also use the European Online Dispute Resolution platform: http://ec.europa.eu/odr.
